Decision on Nadiem Makarim's Legal Challenge to Be Announced Today

TEMPO.CO, Jakarta - A single judge at the South Jakarta District Court is set to announce the decision on the pretrial filed by the former Minister of Education, Culture, Research, and Technology, Nadiem Anwar Makarim, today, Monday, October 13, 2025. The session, scheduled for 1:00 PM WIB (Western Indonesian Time), will determine the validity of the designation of Nadiem Makarim as a suspect in the alleged corruption case related to the procurement of Chromebook laptops at the Ministry of Education and Culture Research and Technology in 2019-2022.

The reading of the decision for case number 119/Pid.Pra/2025/PN JKT.SEL is listed in the Case Tracking Information System (SIPP) at the South Jakarta District Court. "We will deliver the decision, read the decision on Monday at one in the afternoon, and the involved parties are required to be present at the specified time," stated Judge I Ketut Darpawan on Friday, October 10, 2025.

This pretrial has become the culmination of a legal dispute between Nadiem and the Attorney General's Office, which designated him as a suspect in the education digitalization program. At the previous session on Friday, both parties presented their final conclusions. Nadiem's legal team, led by Hotman Paris Hutapea, deemed the suspect designation legally flawed as it was not accompanied by an official state financial audit from the Supreme Audit Agency (BPK) or the Financial and Development Supervisory Agency (BPKP). They also presented a criminal law expert from the University of Muhammadiyah Jakarta, Chairul Huda, to strengthen this argument.

In contrast, the Attorney General's Office stated that the formal requirements for designating a suspect had been met, supported by four pieces of valid evidence, including witness statements, expert opinions, documents, and electronic evidence. The prosecutors brought in a criminal law expert from Al Azhar University Indonesia, Suparji Ahmad, who asserted that pretrial proceedings were only authorized to assess the formal aspects of the investigation, not the substance of state financial losses.

The decision to be announced today will test the legal arguments of both parties and determine the validity of Nadiem's suspect status.

Nadiem Makarim's legal team, represented by Dodi S. Abdulkadir, regarded the suspect designation against the former Minister of Education as legally flawed. The lawyers claimed that the Attorney General's Office lacked two pieces of valid preliminary evidence and violated criminal procedural rules.

"Valid preliminary evidence must meet quantitative and qualitative requirements," stated Dodi in a phone call with Tempo on Sunday. "Investigators solely relied on witness examination reports without evidence of the alleged criminal act, namely state financial losses."

According to the legal team, the Attorney General's Office did not first question Nadiem as a potential suspect before designating him as such. They also mentioned that the Letter of Investigation Order (Sprindik) and the Suspect Designation Letter were issued on the same day, September 4, 2025, simultaneously with the implementation of detention.

Furthermore, the suspect designation allegedly did not precede the issuance of the Notice of the Initiation of Investigation (SPDP) and was not accompanied by the results of a state financial audit from the Financial and Development Supervisory Agency (BPKP). "Investigative audits were not conducted because general audits did not reveal any state financial losses," added Dodi.

The legal team also asserted that Nadiem did not personally benefit from the education digitalization project in question. "His actions were not concrete because the digitalization program mentioned in the accusation did not even exist during the pandemic," stated Dodi.

Aside from requesting the annulment of the suspect designation, Nadiem Makarim's party also requested that, if the case proceeds to the prosecution stage, Nadiem's detention be replaced with city or house arrest. "We will exercise Mr. Nadiem's constitutional rights as a citizen to demand if there are any violations of his rights," said Dodi.
