Breaking News: Indonesian House Passes KUHAP Bill

TEMPO.CO, Jakarta - Indonesia's House of Representatives has passed the Draft Law on Amendment on Law Number 8 of 1991 on Criminal Procedure Code (KUHAP). House Speaker Puan Maharani approved the KUHAP Bill in a House plenary meeting today, Tuesday, November 18, 2025. 

"The time has come for us to seek approval from the House factions for the Criminal Procedure Code Bill. Do we have approval to pass the Bill?" she addressed House members at Nusantara II Building of the House of Representatives, Central Jakarta.

The attending House members responded in unison, "Agreed," followed by Puan's gavel. They also applauded to celebrate the ratification.

The Chairperson of the House of Representatives' Commission III, Habiburokhman, previously claimed that the new Criminal Procedure Code is a legal move towards genuine justice. KUHAP, he said, is required alongside the new Criminal Code (KUHP), which is set to take effect next January.

"KUHP as substantive law must be complemented with operational law, namely KUHAP, as both will come into effect on January 2, 2026," said Habiburokhman.

In front of the House members, Habiburokhman denied how rushed the KUHAP Bill was drafted. "In fact, if I calculate, it took more than a year," he insisted.

The Timeline of the KUHAP Bill Drafting Process

In November 2024, the Council's Expert Body was assigned to draft the academic manuscript of the KUHAP Bill.

Then, on February 18, 2025, the KUHAP Bill was designated as a House proposal, and subsequently in March,  the parliament received a decree from President Prabowo Subianto regarding the appointment of a government representative to discuss the KUHAP Bill.

On Thursday, November 13, 2025, the House Commission III and the government agreed on the draft provisions under the KUHAP Bill, and it was brought to the second-level discussion in the plenary session for approval.

Based on the report provided by Habiburokhman, House Speaker Puan Maharani then sought the approval of all lawmakers attending the plenary session to approve the KUHAP Bill to become a law.

Today's plenary session of the House of Representatives was also attended by Minister of Law Supratman Andi Agtas, Deputy Minister of Law Edward Omar Sharif Hiariej, and Deputy Minister of State Secretariat Bambang Eko Suhariyanto.

Protest Outside the Parliament Building

Meanwhile, outside the House of Representatives building, civil society groups had gathered to oppose the ratification of the KUHAP Bill. Criticisms against the draft law have been mounting since the KUHAP Bill discussion kicked off at the parliament.

The Civil Society Coalition believed the process was rushed and was forced to be enforced in conjunction with the KUHP next January.

Yet, the revision of KUHAP has not yet fulfilled the three main principles of meaningful participation, namely the right to be heard, the right to be considered, and the right to be explained.

Moreover, the Coalition even stated that the House Commission III had manipulated the principles of meaningful participation during the discussion of the KUHAP Bill.
