Ministry Claims New KUHAP Upholds Human Rights Despite Backlash

TEMPO.CO, Jakarta - The Ministry of Human Rights has spoken up about the new Criminal Procedure Code (KUHAP), which was ratified by Parliament on Wednesday, November 19, 2025.

Minister of Human Rights Natalius Pigai asserted that the majority of the new regulation aligns with human rights principles. "Eighty percent of human rights elements are included," Natalius stated on Friday, November 21, 2025.

According to Natalius, his ministry submitted various recommendations for human rights protections to Parliament during the drafting process. He noted that Deputy Minister of Human Rights, Mugiyanto, was responsible for conveying these key points during discussions.

However, Natalius acknowledged the wave of rejection from civil society regarding the new code.

"If there are those who feel that their concerns have not been addressed, we are ready to facilitate [dialogue]," he said during a press conference.

Natalius asserted that his ministry is prepared to relay public criticism to Parliament. He further promised to submit corrections if the legislation is found to be inconsistent with human rights principles.

Civil Society Opposition

The enactment of the new KUHAP has sparked strong opposition. Amnesty International Indonesia views the legislation as a setback in the state's commitment to respecting, protecting, and fulfilling human rights.

Wirya Adiwena, Deputy Director of Amnesty International Indonesia, believes the revised substance of the KUHAP is still laden with problematic articles. He specifically highlighted concerns regarding the authority to conduct arrests and detentions without court permission.

According to Wirya, this authority grants the police excessive discretion and has the potential to trigger arbitrary mass arrests.

"This is a violation of the right to defense and a fair trial," he said.

Wirya also expressed concern that this expanded authority is not balanced by adequate access to legal aid. "The current revision of the KUHAP places the authorities in a dominant position without adequate accountability mechanisms," Wirya concluded.
