TEMPO.CO, Jakarta - A video circulating on social media shows an Indonesian spice product bearing the Prop 65 or Proposition 65 label from California. The label warns consumers about potential cancer-causing substances found in the product.
What is Proposition 65?
Proposition 65 is a California law that requires businesses to provide warnings if their products expose consumers to chemicals known to cause cancer, birth defects, or other reproductive harm.
The California Office of Environmental Health Hazard Assessment (OEHHA) is responsible for implementing and enforcing Proposition 65.
The law applies to companies with 10 or more employees that do business in California, including those that sell products online or through catalogs to California residents.
What does a Prop 65 warning label mean?
It means the product contains one or more chemicals listed by the state of California as potentially harmful. The label serves as a notification that long-term exposure may pose health risks.
What kind of chemicals are on the Prop 65 list?
The list includes both natural and synthetic chemicals found in pesticides, household products, food, pharmaceuticals, dyes, solvents, construction materials, and even vehicle exhaust. As of now, the list contains around 900 substances.
The list is reviewed and updated at least once a year. It has grown significantly since it was first published in 1987.
When was Proposition 65 passed?
It became law in November 1986 after California voters approved it with 63 percent in favor. Its official name is the Safe Drinking Water and Toxic Enforcement Act of 1986.
The law also prohibits the discharge of listed chemicals into drinking water sources and mandates public disclosure to help Californians make informed decisions about their health.
Are all products with these chemicals required to carry warnings?
Not always. Warnings are only required if the exposure levels exceed what the state deems a significant risk. If exposure is very low or below the safety threshold, no label is needed.
What are the penalties for violating Prop 65?
Businesses that fail to provide required warnings can face fines of up to US$2,500 per day for each violation.
