Lawmakers Ignore Disability Aspirations in New Criminal Procedure Code, Says Coalition

TEMPO.CO, Jakarta - The National Coalition of Persons with Disabilities for KUHAP Reform disclosed that it had shared its aspirations and criticisms on the draft law on the Criminal Procedure Code (KUHAP Bill) with lawmakers since September 2025.

The Executive Director of the Center for Law and Policy Studies of Indonesia, who is also part of the coalition, Fajri Nursyamsi, said the group had presented arguments and proposed wording changes in the KUHAP Bill. "Even the head of the Legislative Body at that time agreed that the input from the Disability Coalition could be accommodated," said Fajri in a written statement on behalf of the coalition on Tuesday, November 18, 2025.

But the suggestions were largely ignored, Fajri said, as the latest draft law contains no changes pertaining to disability aspirations. The group believed the Legislative Body only waived its obligations by engaging in discussions with the Disability Coalition, without any meaningful participation.

Even if lawmakers did not agree with the input given, according to Fajri, the parliament must give a response or answer. "Because meaningful participation for disability groups in the drafting of the Criminal Procedure Code is important and should be implemented," he said.

"Since the provisions will be binding and impact persons with disabilities who are dealing with the law."

House Speaker Puan Maharani earlier gavelled the approval of the KUHAP Bill during a plenary session held on Tuesday, November 18, 2025. "The time has come for us to seek approval from the House factions for the Criminal Procedure Code Bill. Do we have approval to pass the Bill?" she addressed House members at Nusantara II Building of the House of Representatives, Central Jakarta.

The attending House members responded in unison, "Agreed," followed by Puan's gavel. They also applauded to celebrate the ratification.

The Chairperson of the House of Representatives' Commission III, Habiburokhman, previously claimed that the new Criminal Procedure Code is a legal move towards genuine justice. KUHAP, he said, is required alongside the new Criminal Code (KUHP), which is set to take effect next January.

In November 2024, the Council's Expert Body was assigned to draft the academic manuscript of the KUHAP Bill.

Then, on February 18, 2025, the KUHAP Bill was designated as a House proposal, and subsequently, in March,  the parliament received a decree from President Prabowo Subianto regarding the appointment of a government representative to discuss the KUHAP Bill.

On Thursday, November 13, 2025, the House Commission III and the government agreed on the draft provisions under the KUHAP Bill, and it was brought to the second-level discussion in the plenary session for approval.
