TEMPO.CO, Jakarta - The Attorney General's Office said legal actions can be taken against foreign executives of the state-owned enterprises (SOEs) if proven to have committed crimes.
"We adhere to positive law, yes. As long as the crime is done within Indonesian jurisdiction, then Indonesian law applies. Meaning, anyone can be subject to criminal charges," said Head of the Public Relations Bureau of the Attorney General's Office, Anang Supriatna, on Friday, October 17, 2025.
The decision to allow SOEs to be led by foreigners was revealed by President Prabowo Subianto in a dialogue with the chair of Forbes Media, Steve Forbes, at the 2025 Forbes Global CEO Conference in St Regis, Jakarta, on Wednesday, October 15, 2025.
Prabowo said that he has amended the regulations governing state enterprises to be led by Indonesian citizens. "Now, expatriates, non-Indonesians, can lead our SOEs. So, I am very excited," said Prabowo.
Referring to Law No. 16 of 2025 concerning state-owned enterprises, a director of an investment holding, an independent board of commissioners, as well as the director and the supervisory board of SOEs must be an Indonesian citizen.
State Secretary Minister Prasetyo Hadi explained that there is nothing wrong with foreigners holding key roles in state-owned companies. "Let's not close ourselves off or question the identities as Indonesians or foreign nationals," said Prasetyo on Friday, October 17, 2025.
He claimed that the Prabowo administration will still encourage Indonesians who have the capability to lead state enterprises, likening SOEs to the coach of the Indonesian national team. According to him, if there is a competent local coach, then they will be appointed. Otherwise, the national team will employ a foreign coach. "Because sometimes we need that to drive us forward," said Prasetyo.
